Terms and Conditions
By signing up and actively using KeenSurf's Auto Traffic Exchange, you agree to all
terms and conditions set forth in this agreement. KeenSurf may, at
any time, choose to edit, add and/or delete portions of this agreement and
impose changes without prior notification of its members. Members will be
informed of any and all changes to this policy via an email to their primary
contact email address provided upon signing up with KeenSurf. If any
modification is unacceptable to you, your only recourse is to terminate
this agreement. Your continued participation in the KeenSurf program
following our posting of a change in policy notice or new agreement on our
site will constitute binding acceptance to the change.
Responsibility of Members:
You must be 18 years of age or older. Minors must have parental consent to participate
in this program. Our program is open to both US and International members
and is void where prohibited by local governing laws. You agree to and must
use your own name and email address in the sign-up process and may not assume
a false identity.
If you deleted your account, you may re-signup at any time.
However, each individual may only have one active account at a time.
You will use your email address /
password combination to access your account; it is your responsibility to
keep this information confidential. You may change this information by logging
into your KeenSurf account and pressing the "edit account" link.
Any solicitation of advertisers for a confirmation email for purposes of
receiving credit in your account will be grounds for immediate termination.
You are solely responsible for any and all use of your account
including authorization by you to any third party individual who may use
your account. Should any instances of fraud, system abuse, or any type of
activity deemed to be inappropriate or illegal by KeenSurf be detected,
it may result in member termination and possible legal action. You must
maintain your email account that you used when signing up KeenSurf to receive
updated status or any notification relating to KeenSurf.
Relationship of the Parties:
You and KeenSurf are independent contractors, and nothing in this Agreement
creates any partnership, joint venture, agency, franchise, sales representative
or employment relationship between you and KeenSurf. You understand
that you do not have authority to make or accept any offers or make any
representations on behalf of KeenSurf. You may not make any statement,
whether on your site or otherwise, that would contradict anything in this
section. You are solely responsible for the reporting and payment of any
taxes for money earned while using the KeenSurf program.
Limitation of Liability:
KeenSurf will not be liable for lost profits, lost business opportunities, or any
other indirect, special, punitive, incidental or consequential damages arising
out of or related to this Agreement or KeenSurf program, even if KeenSurf
has been advised of the possibility of such damages. Furthermore, KeenSurf
aggregates liability arising under this Agreement will not exceed the amount
of the total fees paid or payable to you under this Agreement. The provisions
of this Section survive termination or expiration of the Agreement.
Spam:
You may not promote your referral links through unsolicited emailing (i.e. SPAMMING),
newsgroup postings, or any other method of mass communication. Failure to
comply will result in immediate termination of your membership with KeenSurf
and may result in legal prosecution. KeenSurf strictly enforces anti-spamming
laws. Spamming is a federal crime. Any member caught spamming will not only
have their account terminated immediately and lose any past, present and
future earnings, but shall also be held liable for Spamming as we shall
cooperate with any authorities and investigations that may arise from the
Spamming incident. KeenSurf may charge up to $5 per spam email sent.
Multiple signups shall be grounds for immediate termination of all involved
accounts. Signing up multiple times from the same computer also constitutes
fraud. KeenSurf may file charges for recovery of any earnings received
from multiple signups.
Although KeenSurf's host is not expected to go down often, there is a possibility
that its host can go down right after a member unsubscribe to KeenSurf and before the webmaster
is able to backup the most current database. Therefore, an unsubcribed member may receive
an email from KeenSurf when the webmaster emails members in masses. The member agrees not
to accuse KeenSurf for scamming but instead login back to KeenSurf's Members' Area
and delete his/her account again.
Note: the possibility of this is highly unlikely, but I just want to mention it so members will
be aware of it just in case it ever happens.

Web Hosts' Failures and Cancellation of KeenSurf Services:
At times, the web host of KeenSurf may not be operational and KeenSurf will be unable to
provide its services for its members. However, most of the time, if not always, this
will only be temporarily; and KeenSurf will be up and will continue to provide services
for its members in a couple of hours. However, sometimes KeenSurf may be inoperational
for days.
To ensure that the members will recieve the notification of the status of KeenSurf, there are 3 possible ways:
1. An email will be sent to each member's emailbox that he/she has registered with KeenSurfand states clearly the cause of the temporary inoperation or an expected cancellation date. However, if KeenSurf's
host happens to be inoperational hours before the webmaster created a backup, KeenSurf backup file may not be up
to date; and new members
may not receive the notification. In that case, the 2 additional ways below are listed for reference.
2. Copy and paste this url into your browser: KeenSurf.com
If you see KeenSurf site, look at the site for any notice or announcement listed below the "News" heading.
3. If number 2 does not work (for example, you do not see the KeenSurf site), you may email the webmaster at
ads4fair@mailcan.com and ask for the current status of the KeenSurf program or any expected cancellation date.
